Q: My ex-husband was ordered to pay $1590.00 month for 2 children. We agreed on $1150.00 month

not done through payroll deduction so payments weren’t always consistent or correct. He wrote up an agreement that we would do visitation on a week to week basis vs him getting them every other weekend. Thus, him no longer paying child support but providing for the kids on the weeks they were with him. In the past year he moved about 40 min away, thus no longer getting kids week to week due to the distance it would take my daughter (17) driving back & forth from school + the kids having to get up earlier, etc. Kids are now going to his house every Friday & coming home Sunday morning. He has been paying $250. Month for the past several months but I have requested that he pay more due to the fact that $250. is not enough to cover food, medical, clothing, school, etc. He recently got married to a woman with 2 children. what can I do?

A: Hello. An attorney would need to see the Court order and then any subsequent agreements made between the two of you. It is impossible to know the validity of any additional agreements without reading everything. Regardless, contempt and modification are always available as options to clear the air and recalculate child support. You would do well to seek counsel where the case is so he/she can be fully informed to give you accurate legal advice. Best of luck.
