Westminster, CA asked in Car Accidents for California

Q: How long can claim go on?

I rear ended a car and insurance of party that I rear ended asks 6700 for car and around 30-40K might be asked for bodily injury. However accident happened on September and it is February I haven't heard from the insurance of the party that I rear ended. How long can they get the back pain treatment? Also she said to police officer that she had no pain, but police did not conducted a report since everyone were ok.

A: Cases can go on for years. Treatment can go on for days, weeks, months, years, depending on the injury. It is common to not experience pain immediately after the collision, but when the adrenaline wears off, or you start to resume normal activities, pain surfaces. If you have insurance, notify it of the claim against you. If you don't have insurance, you will either have to pay yourself, or file for bankruptcy. A consultation with a PI attorney might be useful to discuss your settlement options, if you are not insured.
