Q: Insurance company refusing to cover saying that I used a car in scope of business when it is not what really happened.

I rear ended a car after picking up my daughter from preschool and was driving to check out cleaning in one of homes I work with (I am in real estate, don't do cleaning myself), appointment got canceled and after I got into accident. My insurance agent had me on phone saying that I make money of real estate and now they are refusing to cover me saying that car was used in scope of business. However I did not make money while driving, even after I would got to the destination I would not make profit, since it was random checkup. Anyways they used my language barrier and had me saying I was driving for business. I have evidences texts from contractors saying that appointment got canceled and from my other contractors stating that I don't have any benefit from cleaning. Do you think I can sue them? It is mercury insurance.
