Q: Can I sue the City of San Diego for age discrimination related to the scooter ban?

Many seniors, like myself, depend on pedal assist ebikes for exercise and transportation. California law permits pedal assist bikes on Class 1 bike paths designated for pedestrians and bicycles. However, San Diego's scooter ban includes pedal assist electric bikes. The city has effectively legalized age discrimination against seniors who need the electric assist in order to stay active and fit. In fact, most ebikes are purchased by older citizens. The city has forced senior ebike riders off the safety of Class 1 bike paths and onto more dangerous streets where there are no marked bike paths, and the condition of the roads makes navigation hazardous and difficult. Please advise as to available legal recourse against the city of San Diego in resolving this issue.

A: I'm not too sure about suing for age discrimination, but you can certainly sue for violation of your civil right to choose your mode of transportation in the safest possible manner. Of course, you will need a good civil rights lawyer and a good firm to represent you in this very interesting case. There are a lot of good lawyers in San Diego who can take on such a case.
