Q: My landlords are demanding entry to my house for a refinancing inspection. I asked them not to due to coronavirus.
The landlords are citing the lease which states that they or their agent have the right to enter the house for an inspection. I think this leaves room for interpretation. They think this is exactly what they are doing, but the lease doesn't state we have to let the bank in. We, my partner and I plus our neighbor on the same property, asked if they could postpone. We are not comfortable with strangers entering our home, especially because I have asthma and feel especially at risk. They told us it's not a question, they must and will enter the property. Is this true? During a pandemic and state of emergency do they still have the right to enter?
A: The landlord has the right to enter for an inspection. However, we are in the middle of a national crisis. You have stated an argument which may stop an eviction for a short while but eventually the house will be sold. There is no stopping that. So, why not suggest to the management, that you will allow their inspector to enter your residence, if he wears a hazmat suit and decontaminates your house before and after an inspection. that will assuage your fears and will make everyone safe. By doing that, you are not rejecting the landlord's right to enter but you are , as well, protecting all parties. Best of luck.
