Q: Are there any time limitations to claim a part of the property that was adjuged by the court in the state of New York?

In 1982 I got a divorce from my wife. My ex wife and our two daughters lived in the house in Suffolk county, NY. In case she sells the property I was supposed to get one third. I did not claim my portion because of the daughters, but my ex wife died in 2004, and the property was sold I believe by my ex wife's brother without my permission. I was a co- owner of the property. After my ex wife's death the property should be split between two of my daughters and me. The sale of the property was done unlawfully. The house was sold for $300000 in 2004. Now this kind of property is between 400- 450 thousand. I want to know is there any chance to get my portion of the property?

A: I would think that there is a good chance to get a portion of the proceeds. But you would have to ask a New York attorney; it has nothing to do with Florida law.
