Q: How can i find out if estate has paid off car that was left to me? Agent told me i have to refinance what is due

My boyfriend who left the car to me told me that estate will pay it off.

A: You should contact the personal representative of the estate. Leaving the car to you doesn't mean that the estate will pay off the loan, absent specific instructions in the Will.

You will want to review the probate documents that were filed and the Will. If you were named in the Will you should have been given document and notification, as an alternative you can check online in the county where your boyfriend lived with the clerk of the court to see what has been filed and done. If you are a named beneficiary in a Will/probate you should receive notifications.

A: And if your late boyfriend told you that the car would be paid off, but the will doesn't indicate that, you may be out of luck. That's what the will requirement is for: to ensure that last wishes be reduced to writing and comply with certain formalities. Without written wills, probate would be very complicated indeed.
