Q: Child support continuance after age of 19?
My divorce decree was final in 2018. I made sure to remove all comments about support for college education from our settlement. My child is a senior in high school this year and approaching his 19th birthday. If he chooses to go to college and not get a job are my child support payments to continue for him? Is it mandatory? Are the current rates required? Seems like as an "adult" he should get a job! He has 2 younger brothers one is 16 the other is 10.
A: Hello. Based on what hou have said, you would not owe him support past his 19th birthday. If you're required to pay support for the other two children, you will need to file a modification to have your payments recalculated. Otherwise, child support will continue until you file to stop it. Best of luck!
A: You cannot be ordered to pay post minority support under the rule announced in a case called In Re Christopher. Your child support for that child ends at 19. You WILL have to go to court to adjust the support for two children other than three. Do not assume that the child support will go down. Depending on incomes, etc. you will have child support re calculated for the remaining two children. You can't just reduce the support by 1/3 or something like that. See an attorney.
