Q: Is it fair for the lawyer to get the majority of the clients settlement?

A: There is no universal answer to your question. As a general matter when handling injury cases on a contingency basis, attorneys fees run in the ballpark of a third of net recovery. Some attorneys may charge higher percentages, some may charge lower percentages on other types of cases involving recovery of some kind, as in collection matters. And some attorneys charge by the hour or on a flat-rate basis. Without knowing what type of matter your case involved, whether high-cost expert testimony was necessary, it was a costly and protracted trial, it's hard to say. Attorneys sometimes decline situations where the outcome is similar to what you describe because it could mean that the recovery was out of proportion with the resources needed to pursue it.
