Oakland, CA asked in Personal Injury for California

Q: witness to sign affidavit for Trial. not sure of correct date of accident can this be left out of his statement?

Upcoming Trial WC. I want to have this witness sign an witness statement to

bring with me to court and submit to the Judge. The actual date of this accident

was incorrect on paperwork So it was settled on another date and used on all

correspondents etc since then.

May I have him leave out the true date and just state he does not recall the

actual date, but it was the beginning of the month or just leave it out.

My trial is in June.. Is there some kind of sample letter of witness that I

can use. Confused! What can I do? My WC attorney is not helpful and

very busy, so I want to have this letter from my witness on the day of my

trial... Help..... Please! I have used your company assistance and always

your company answers are always soo Helpful!

A: MORE INFO NEEDED.

BUT, NEVER GIVE SOMETHING TO YOUR LAWYER ON THE DATE OF TRIAL.

THE STATEMENT MAY NOT BE INTORDUCABLE SO BRING IT TO THE ATTENTION OF YOUR LAWYER.

CALL THE LAWYERS SECRETARY FOR THE CORRECT DATE....IT WILL BE ON THE MOVING PAPERS...............AND DON'T DISCUSS YOUR CASE ON AN OPEN FORUM LIKE THIS.
