Santa Rosa, CA asked in Civil Rights, Constitutional Law and Criminal Law for California

Q: Can I sue a police officer and the court of Santa Maria for a case related to defamation of character?

2 months ago I got a letter from my car insurance company stating that they needed a copy of my driver license. I called the insurance and they inform me that they pull up my driver record and it shows that my driver license was suspended. Afterwards, I called the DMV and they say the license was suspended due to a traffic violation "I commited" back in 04/01/19. They refer me to call the court and so I did. Talk to one of the clerks and she informed me that I needed to fill a misidentification form along with additional evidence that show I am not the person they are after and after filling out the documents I send that information to them via mail a month and half ago. Moving forward, two weeks ago I called the court once again to get an update on the "investigation" they were doing with my case and now they told me that they have criminal case against me for "driving with a suspended license". This is utterly wrong in so many levels, and its been causing a lot of distress.

i would encourage you to contact a local attorney who is familiar with DMV and Criminal matters.

if you are right you will prevail.

i think the court would probably be protected........and depending on the facts , the officer too.

make an appt with a lawyer.
