A: The answer to your question really depends. A temporary order hearing in a child custody case is generally a hearing to resolve issues that can't wait until the case is completely over and it can have a profound impact on the outcome of a case. Either side to a child custody case can ask a court for temporary orders in their pleadings and set a hearing regarding those temporary orders. If you do ask a court for temporary orders then you are limited at the hearing to arguing what you have asked for in your pleadings so it is important to get it right. If you don't want to ask the court for temporary orders then that is your choice, but you should talk to a qualified attorney before making such an important decision in your case because a temporary order hearing can be the most important hearing in a child custody case and if the other side asks for temporary orders and you don't then you will be limited to arguing only why the orders that they asked for should not be granted. You can't get something from a court if you don't ask for it.
