Q: Were the acts of my estranged spouse’s public defender improper or acts of misconduct?

I’m in the middle of divorce due to domestic violence. Spouse has been served divorce papers & civil & criminal restraining orders. Last month, I filed my taxes as Head of Household & claimed my 4 kids. Also last month, he tried to steal my identity in order to attempt to reroute my portion of my Covid 19 payment. I filed a police report for that. Last week, at my spouse’s request, his public defender who handles his DV case tried to act as middle man in order to try to collect his portion of his Covid payment from me via CashApp. She corresponded with me first by phone call, then text. I documented the correspondence subsequently via email. I informed her that I didn’t have any funds in any form at that time. This week the check came in the mail issued to “Mr. AND Mrs.”. Since it wasn’t issued to “Mr. OR Mrs.” I wasn’t able to deposit or cash it separately. We have no joint accounts. I informed his PD of this & advised him to contact the IRS to issue his payment separately.

i am not sure what you think was improper.

if a lawyer does anything wrong, the Calif state bar oversees and you can contact them.

i suspect the PD is just trying to do what is in the best interest of his/her client, while still following the law.
