Q: Probability of having orders changed so I can see the kids on 50/50. Currently on a 80/20.

Ex says her attorneys think it would be a complete waste of my time and money and that going to court would backfire on me.

I have strong evidence of poor living conditions. and her claiming to be too sick to do things such as shoping at the grocery store. I also have moderate evidence of the kids not getting medical attention.

Divorce was 7 years ago. Kids are 11,13,15,17

A: If the evidence you have is as strong as you say it is, I think that it is likely that you would get better access than you have now. Such a question is very fact specific, however. The results in the case will depend on the strength of our evidence and how the Judge sees it.

If there has been a material and substantial change in circumstances since the court signed your old order then it is possible that a court would change the old order. It would be wise to have a qualified divorce lawyer examine the details and circumstances surrounding the items you mentioned above, and any possible other issues, to determine if any changes that have occurred since the signing of the old order, rise to the level of a material and substantial change. A familiarity with case law, and how to use it, is useful in such a determination and therefore a lawyer's assistance would be helpful to you.
