Mountain View, CA asked in Employment Law and Civil Rights for California

Q: I followed instructions EDD provided to the exact. Why is it only getting worse?

They keep making up the rules as they go. Right now I feel stolen from. I have appealed their incorrect determination of False statement since 2018. I still have no idea what they are referring to. I have tried to reach out to them on multiple occasions. Their site is set up for those to fail. Now with the imposed on unemployment I was reassured by everyone inlcuding my employer that my re-apply will be ok. Just payment and over payment. No. The unjust false statment penalties have prevented me from being paid what I earned. I was forced to move my claim to PAU by reps who are not consistent with their information. Plus giving out my social to strangers via phone to do so. My PAU claim file has a mind of its own and has changed and renamed certifications without my knowledge. Currently they took the $600 I was promised by the rep will be my payment. I am defeated and have suffered many mental breakdowns. This is just the tip of the ice berg. I feel powerless but keep fighting.

A: I am sorry to hear about your predicament, but, of course, no one here can know why this is happening to you or why it is getting worse, which was your question. The system is flawed and overburdened right now, so there will be situations like yours where people fall into the cracks and are left without money. All you can do is to simply stay on top of it, continue to work through the system, and hope that eventually there will be a resolution.

Good luck to you.

A: Try going to the Labor Commissioner's office for help. Cut and paste this link into your browser and then file your claim and have your employer investigated to see if they are doing anything improper.

The Labor Commissioner's job is to protect workers like you from being cheated by their employers. But if you need a lawyer to assist you, go to the California Employment Lawyer's Association website and find the best lawyer to help you.
