Q: Is there a way to contest untrue “notices of violation” ? I’m afraid if I don’t they will use them against me later
New building manager has it out for me. I’ve lived here going on 4 years now and am on month to month lease, never had any issues. Now with the new manager I have gotten 2 notices of violation in as many weeks. However both notices are not true and I feel they are doing this so they can show paper trail of “problem behavior” in the event we get evicted down the road And we take it to court. I want them off my record if there is such a thing I just don’t know how or if I can contest them. Our building has cameras, there is video prof that corroborates my side but their cameras only keep the last 30 days saved.
A: I agree that it is wise to make a written response now - not so much because it will accomplish anything immediately but it does keep the record straight and you are right that they otherwise may try to use their current complaint letters against you later. So send them back as neutrally toned but focused of a response and reply as you can systematically arguing against their allegations. Also request (assuming it is too late now) that if there are any future complaints, that they preserve the video of the incident. Also, of course, keep a copy of everything and your own file with as much documentation and defense as you can. If things escalate, consider reviewing it all with a local landlord-tenant attorney.
