Q: Notice of non-renewal of lease.

I own a duplex and I live upstairs. The tenant downstairs has lived there for three and a half years and her lease will be up in January. I do not want to renew her lease because she is a liability to our property and personal safety (leaving doors open/unlocked, garage door open, also causing a small fire, with only minimal damage, by leaving on heating pad, has almost left on a hair straightener on for four days when leaving for vacation). When do I legally need to give her notice of not renewing the year to year lease?

A: If your lease does not have auto renewal, or doesn't require you to give notice, then you don't have to. But to get tenant to leave on time, give notice in advance to reduce the chance you have to file an eviction.
