San Jose, CA asked in Domestic Violence for California

Q: I am 19 years old and i am planing on moving out. My parents are abusive both mentally and physically.

I’m moving in with a friend and her mom is on probation. Are there any possible repercussions that can happen for my friend or her mom? She’s on probation for a DUI. what i’m afraid is that my family will try to file a report against the family i’m moving in with. what can i do to prevent this from happening. i do not have any previous criminal record.

A: Since you are over 18, in the eyes of the Law, you are entitled to move out, unless some other disability or court imposed condition exists. Being on probation for a DUI is serious, but not that serious, it is usually not a supervised probation, unless you killed someone when you were DUI. There is NOTHING you can do to prevent your family from behaving in any rational or irrational way, you have to deal with it after the fact. If they physically harass you, it may be possible, in the correct circumstance, to get a Harassment Restraining Order that includes your friend and his mother, but again, this must be after the fact.
