A: Under the California Labor Code, all commission agreements must be in writing. The statute of limitations for enforcing a written agreement is 4 years. The SoL for enforcing a violation of the Labor Code is 3 years. So, if you have a written agreement, you still have time, if you don't you may be too late. You should definitely contact a local attorney specializing in Wage and Hour law, to discuss your particular case in depth.
