Sharpsburg, GA asked in Divorce and Child Custody for Georgia

Q: Could someone assist with parenting plan wording / out of state travel?

Parenting plan reads "notify other parent of out of state travel fifteen days prior unless emergency or spontaneous road trip”. I haven’t even confirmed the trip but informed the other parent that I’m considering traveling and it is currently eight days out. Is there a timeframe for spontaneous in this situation? I can’t notify fifteen days out of I haven’t even planned it. Thanks for the assistance.

A: If your parenting plan says you have to give 15 days notification and there is no clause for spontaneous travel, then you would need to give the 15 days notice. If it’s not possible you may want to speak to the other parent about it and work it out amicably. Without seeing your parenting plan we don’t know if there is a clause to allow for a shorter time frame. -Homer P. Jordan IV, Esq. 404-620-1558
