Q: CPS closed my case and said I need my own home before I can re-petition the court and get my kids. Can they do that?

I currently live with in-laws and have lived with them for several years by choice and because we all like living together. No one my household has ever been in trouble or had a CPS case against them. I complied with CPS the entire time and each time i did what they asked they always came up with something else. The home in which I live in is clean, and there is a bedroom for my kids. Now they say I must have my own home for 6 months and show proof that i pay for everything and then I can re petition the court and ask for my kids back.

A: They can request you be ordered to do that but only the judge can order you to do it.
