A: A Texas attorney could advise best, but your question remains open for three weeks. This could be a difficult matter because the bills appear to go back a number of years. Based on the information, it's difficult to say why the bills went into collection - was it coverage issues, medical necessity denials, or lien-related issues? The answers to those questions and others could determine your options. Maybe a starting point could be to ask the help of your attorney who represented you in the personal injury case. If your insurance carrier pursued their payments in a subrogation claim, it's possible they could have placed liens on your award. Can you sue? Based on these facts alone, I don't see the basis for a lawsuit - but the best person who could answer that question could be your attorney, or another Texas attorney who could review the medical services/billing portion of your personal injury file. Good luck
