Q: I have been falsely charged and a warrant issued against me in wisconsin, without even one shred of evidence.

l have fought for,and gained custody of my 4 yr old son,after his mother was killed in a tragic auto accident in Minnesota. Before she died,her other child's father,who l have never met,or even spoken to, filed completely fabricated misdemeanor charges against me,without even one shred of evidence, and on his word alone.And now there is a warrant against me in Wisconsin.I absolutely refuse to let them arrest me,therefore causing me to lose my son,our home,and everything we have,only for them to figure out later,that l am innocent, and will not even get an apology for being arrested,put in jail,and lose everything l love,just to prove my innocence. I don't know how,in this day and age,someone can just make something up,and on his word alone,charges be filed,and warrants be issued,without any proof or evidence whatsoever, please help me and my son to resolve this very troubling and potentially life threatening matter, without us having to lose it all in the process,thanks and God bless.

A: Refusing to address the charge isn’t going to get you anywhere. A judge isn’t going to address the propriety of the charges so long as there is an active warrant for your arrest. You should retain an attorney and either turn yourself in on the warrant or post bail to get the legal process going. Otherwise the warrant is going to remain out there and nothing will happen with your case.
