Q: My sister's funeral was held on 8/4/20. Can a landlord give a 4-day notice to clear properties w/ a minor involved?

I live in NC but my deceased sibling loved in Cleveland. I have just received word that the landlord is just, on today, that the landlord says my Nephew (adult, who was living in the home along w/ my sister and the minor involved), that he can reapply but if the application is not approved, my family has 4 days to vacate all belongings.

A: If the nephew and others were not on the lease, then landlord can start an eviction by giving a notice to vacate, and if they don't leave, then filing the eviction with the court. That eviction process can take a few weeks until the hearing. The landlord cannot legally throw them out after 4 days, but must wait for a court to order the eviction. So your nephew should either look for a new place, or fill out the application.
