Richmond, CA asked in Small Claims for California

Q: Hello, so I need advice.

My ex Girlfriend was driving my vehicle as i was not able to drive to my physical therapy I asked if she could please drive me to the Hospital where i am scheduled to go, i was having back problems that were preventing me to drive that day as my pain varies from day to day. As She began to pullout of my parking Garage she decided to answer a phone call that happened to be a scam call, i pressed the issue that perhaps it wouldnt be a good idea to answer the call since i was running late. which she ignored. as we pull out she hits a pole that is next to both the gate and the box that opens and closes the gate. Normally in order to pull out you are supposed to turn left and reverse out of the garage gate. but she turned right and damaged the back passenger door of my vehicle got it stuck and couldnt move the vehicle. I have given her both time and suggested making small payments for damages she has not made one payment even though she agreed on it in the first place.

A: So, are you asking for relationship advice or are you looking to take your soon to be ex-girlfriend to small claims to get her to pay you for the damage to the car? I guess you need to decide which is more important to you, the car or the girl, both bring pleasure and cause misery in your life. If you choose the car, then you can file in small claims against the girl, and you will get a judgment, which is a piece of paper that you have to collect on. Collection is not easy nor is it fun.
