Q: My 13 week old dog was in a storage container with the lid half on it, it was not closed at all. The cops came

for a different reason and didn’t find what they were looking for so the claimed that the lid was closed air tight on the container and another bin was on top with the dog inside. They also stated the dog was malnourished with no food or water, yet the bowl of food and water was right next to her. As well as two bags of dog food in the kitchen. They also stated I had six dogs when I only have 3. I was arrested and sent to jail for animal cruelty of that one dog which is the fattest of all my dogs and I just got her Tuesday. They never took my dog nor called animal control. Can I fight this and sue the police dept for making a false report? They claimed to have their body cams on if so they would show that the bin was not closed at all.

A: No lawyer will take your case to sue the police department for this. You have no business putting a puppy in a storage container; a puppy is not a piece of furniture. That alone is animal cruelty. Most parishes have a municipal statute forbidding the ownership of more than 5 animals without a license to breed animals. A 13 week old puppy should still be nursing, unless you just purchased the puppy, in which case it should be eating puppy chow, and not dog food. At 13 weeks it should also have been wormed and given it's first round of shots.
