Los Angeles, CA asked in Traffic Tickets for California

Q: First speeding ticket have to go to court and I have a few questions .

Hi recently received a speeding ticket in ca I was going 85 in a 55 zone. This is my first ticket ever and I have to go to court for it. My question is does the judge decide how many points go on my record or will he allow them to be removed by going to traffic school? I read online because how fast I was going it’s usually two points on your record and they can’t be removed by traffic school usually.

A: The red lights in the rear view mirror are one of life's worst moments. Speeding through a construction zone on the fwy, I would estimate. The DMV decides about points. It is possible you could do Traffic School and get this off your DMV record, and INSURANCE record- will most likely increase if the Ins. knows about it, could be a substantial increase. I am not sure about 2 points vs 1 point, usually has to be higher speed, like 100+. Usually Traffic school restriction is for over 90 mph. But I want you to really think about the hazard of going this speed on an uncontrolled public road, where there are drivers often over 70 or 80 years old/ slow reaction times (like me), and the fact that no vehicle is crash tested for safety at 85 mph. You are not out there with a bunch of professional drivers, and anything can happen, and usually does, every day. We have speed limits to try to save lives.
