Los Angeles, CA asked in Car Accidents for California

Q: Got in an accident not at fault with suspended license & have car insurance. Very minor damages to my bumper rear right

Filed a claim with my insurance but I just want to close the claim and just leave as is. The other party never gave out insurance info or had driver license to show me. I just want to know if I will recieve any consequences I know I shouldn’t be driving. And there is no injuries at all and we just pretty much talked it out in the business area where accident was. Hoping I just leave as is and close the claim

A: Nobody knows whether you are going to be charged for driving without a license except the District Attorney. You can close out your claim for property damages to your car. You have no ability to force the insurer to close out the entire claim because it is possible that the other party may claim that you were at fault and that they were injured. Your liability insurer would then have an obligation to defend and indemnify you.

A: You are on the road to losing your driving privilege, and in getting a hefty increase in your auto insurance premiums. These are the consequences you may face. If the collision was reported to authorities, you may be getting a notice from the DMV re: further suspension, so, Mr. Light is not quite accurate in indicating that the DA is the only source of additional problems. DMV has a voice in it also. Your insurance co. probably filed a report with DMV.
