Q: My Drs medical assistant fraudulantly reported to a specialty pharmacy , that I was no longer a patient! Can she do that

A: Fraud is fraud. If all the elements of fraud are met, its not malpractice but Fraud. In this case most likely Fraudulent Misrepresentation. The problem with Fraud claims however, is PROVING IT.

A: Sorry to hear you have this problem. Suggest you make an appointment with your Doctor right away to discuss this with him confidentially. The Cal. Board of Medical Quality Assurance handles complaints against Physicians, who are responsible for the actions of their staff. You can contact them with a complaint. They are on the net.
