Crawfordsville, IN asked in Criminal Law for Indiana

Q: How would my wife address the prosecutor in writing a letter?

My wife and I had a heated argument took my phone and I took it back from her and was gonna take our child and leave and she called the cops and wanted me to leave for the night. Cops show up then I'm arrested and charged with domestic violence, even though she said I didn't hit or hurt her, rufused to press any charges. cops said she had marks on her, only thing I did was just took my phone back from her. I was officially charged with a class a misdemeanor domestic violence, my lawyer hasn't been much help at all, I got a bad lawyer. Been hounding him and he called today and said they would knock it down to class a misdemeanor battery. I'm not guilty of hurting her or bodily injury. She wants to write a letter to the prosecutor but doesn't really know where to start. I can't afford to do a trial. Need suggestions please, or can she hire a attorney to help her with a letter. I know it's up to the prosecutor because it's In the states hands. She will do anything to help me. Thanks

A: It would be expensive to hire an attorney to write a letter. Has she talked to the prosecutor's office, they should have a victim advocate who will discuss her wishes with the case. This should have already been done, since the prosecutor has a legal obligation to get input from the victim on the case. If you are not satisfied with your attorney you should consider hiring another attorney.
