San Diego, CA asked in Landlord - Tenant for California

Q: unlawful detainer filed against me for non payment court date was in March court date reset for 10/8 can I be evicted

I sent the declaration to landlord but fear I can be evicted even though there is a eviction ban till 2-1 am I protected or am I gonna be evicted. If eviction happens I will become homeless should I motion for continuance

When I had a case involving Religious Discrimination in Housing (I specialize in discrimination prevention) I got a Tenant's Rights attorney to join me because I knew there were many issues that I would not be aware of. There are a lot of attorneys in your area that handle Tenant's Rights, you should contact them, go to the CAOC website for a referral, or look on Justia. Don't take your butter knife to a gunfight. The Judge is not there to protect you, only there to decide based on the evidence presented.
