Noblesville, IN asked in Criminal Law for Indiana

Q: am I going to be charge with domestic violence?

Yesterday my wife was intoxicated, stood up in my car. When I braked she fell hitting her head. Braking my windshield. When we got home her and her friend kept drinking. She fell in the driveway hitting her chin and bleed everywhere. And I believe went unconscious. Later I was in bed she fell on the stairs. It was like she forgot what happened. Called 911 saying I hit her. Officers showed up. I was put in handcuffs. Her friend came back over and told the officers she saw her bleeding chin and it wasn’t my fault.the officers took a lot of photos including my windshield and the blood on the driveway They asked her to press charges. She refused. I was released. They had her friend take her home with her. I picked her up in the morning she is embarrassed, injured. But now we are afraid I might be arrested later. Neither of us were given any paper work she only signed a release form from the fire department refusing help. Will I be charged at a later date? This is all terrifying

A: The Prosecutor's Office will review the reports and make a determination if charges are going to be filed. You should contact a local criminal defense attorney who can better answer questions about the Prosecutor's Office and can assist your wife with contacting Victim Assistance to advise them of her thoughts.
