Q: How do I get my security deposit back if cotenants are staying and I am the only one leaving?
I don't want to be responsible for damage that may occur after I leave the property, but my security deposit is still with held by the landlord. What are my rights to get my money back?
A:
Your rights are set forth in your rental agreement. Usually the LL does not have to return the security deposit, or any part of it until the property is vacated, completely. You should be getting it from the co-tenants and provide a written letter to the LL advising him that you ASSIGN your right to any portion of the deposit- AFTER you get the money from the co-tenants.
