Q: Bait and switch for a apartment I was going to move in to. I already signed the lease and gave 30 day notice.

I'm disabled and on section 8. I found a apartment in Sep I was interested in. I found the listing on SMChousingsearch.org. It's a listing site for those on section 8, It's provided San Mateo county housing authority. I gave my 30 day notice to housing authority and my current landlord on Sep 27th. I signed the lease to the new place on 10/7. The listing showed pictures of the unit, on the listing it was marked with asterisk *Top Floor Unit*. I was able to see the apartment today and seen it's actually on the very bottom last floor and the images on the listing wasn't the same unit. I told her that and she said she would never list a top floor unit accepting section 8, all top floor units are over $3,000. I go home to hurry and screen shot the listing before she edit it or remove it. I was able to get proof that it's listed as top floor. I refresh the page literally 15 mins after and it's been edited and top floor removed with other pictures. I'm out of a home, I don't no what to do.

A: You have been subjected to a Civil Fraud. You have preserved your evidence, now you need to decide what to do about it. The immediate problem is where you are going to move to, you have to live somewhere, you might want to move into the apartment where you can keep a closer eye on them and possibly catch them in additional housing violations. Once settled you need to contact a local Tenant Rights attorney. Look on Justia. But consult an attorney about what your next steps are going to be. An alternative is to quit the place before you move in, but before you do that you need to secure a different place to move to.
