Q: My tenant moved in a friend who is not on the lease in New Jersey how much can I raise the rent for the extra person ?

A: Firstly, is a written lease? If so, does the lease specify the number of occupants? Without knowing if thee is a written oral lease, no definitive answer can be give, Also, remember the Court frowns on self-help. Also necessary to know whether it is a studio apartment or an apartment with one or more bedrooms. This is important information because the number of occupants is, generally, in the municipal ordinances. The new occupant may be a violation of the lease or municipal occupancy limits. If the lease limits occupancy, you may send a notice of violation and to quit noting that the new tenant may remain if the monthly rent and security deposit required is increased. Should you receive an unfavorable or no response, file suit in for eviction. Again, no attempts at self help should be made.
