Q: Is the length of term enforceable in an employment contract in California?

A: Your question cannot be answered in a vacuum of facts. Far more would need to be known, but especially the other terms in the contract. For instance, all employment agreements in California are considered to be at will unless otherwise stated in an agreement between employer and employee. However given the right language the parties can agree to an enforceable term of the employment contract. Your answer can only be found in the details of your agreement. A: It depends. Is the contract written? Is the term clear and unambiguous? Are there any conditions precedent? Conditions concurrent? Is the term barred by the statute of frauds? You need to take the agreement to an employee rights attorney for review and an opinion.
