San Diego, CA asked in Car Accidents for California

Q: A car from opposite direction turns on their red light onto street in front of me, am I to blame?

The other driver turned all the way into lane #1 that I was traveling and as I switched to the middle lane to avoid hitting them, they switched also to middle lane in attempt to get BACK to lane #1, the lane they SHOULD HAVE turned into and I could not avoid hitting them from behind.

A: Unless you have dashcam video or independent witness corroboration, you will likely be found liable. You hit someone from behind. You are supposed to control your vehicle taking into account hazards in front of you. Even with dashcam or independent witness corroboration, you will likely have some portion of the blame.
