Q: I have been attempting to gain state employment, specifically Cal Trans, periodically for 20 + years & have been denied

All listed qualifications have been met, I hold a B/S degree, a consistent work history & good references, yet evidently do not even qualify for a entry level Highway Maintenance Worker position. I am being discriminated against.

A: Yes, you are being discriminated against in hiring, however, one cannot say whether you are being discriminated against, unlawfully, based on your status as a member of a protected class. These classes include race, religion, gender, physical disability, age and others. If this has been going on for 20 years, one cannot say whether any job denial claim you may have is barred by the statute of limitations. You should contact a local employee's rights attorney to discuss the particulars of your situation.

A: If you believe you have been discriminated against, then I suggest you go to the California Department of Fair Employment and Housing website and file a claim of discrimination. Go to their website by copying and pasting this link: https://www.dfeh.ca.gov/ and after you get to their main page, hover your cursor over the link for Complaints and then click the link "File a Complaint". Then follow the instructions to fill out the complaint form completely, and then submit the form when you are completely finished with it.

Should you need assistance preparing the complaint form, you can find experienced discrimination lawyers at the website for the California Employees Attorneys Association. Do not sit on your potential claim as you've been doing for the past 20 years, as you indicate you have. You can only file the complaint for the last rejection you received within the past one year only.
