Riverside, CA asked in Criminal Law for California

Q: How much time is my husband going to do for the following charges and priors.

Say that he is found guilty of all charges how much time will he get? Including priors from past charges. If we get a lawyer what are his changes of getting less time and dropping the possession with a fire arm since the fire arm is broken and can't shoot and dropping Grand Theft Auto since he was not aware that his friend soled him a stolen car until the cops told him it was stolen. And what are his changes if we get a lawyer.

A: Yes, he should definitely hire a lawyer. He is facing a potential state prison sentence that could be as much as 8 years, if someone doesn't stop them from punishing him multiple times for one act -prohibited by P.C. 654- as to both gun charges, (11370.1 and 29800), and the drug charges and 11370.1, and the driving of a stolen vehicle (10851) and receiving stolen property charge(496), if it pertains to the same vehicle. Also, the gun must be operable for the 11370.1 charge, but not for the ex-felon in possession charge. You also mention defenses going to knowledge on the theft charges, all of which need to be investigated. By all means consult a qualified, experienced criminal defense attorney. There are many issues that could result in a drastically reduced sentence with good representation.
