Q: What does CRO Program mean in the state of Alabama?

My husband was placed on 5yrs of Community Corrections in July of this year after pleading guilty to a possesion (Class D) felony. To make a really long story short, he checked in with the community corrections officer on 10-26-20 and taken into custody by way of bench warrant for failure to comply with CCP. His revocation hearing was on 11-5-20 and was in fact revoked to serve remainder sentence in confinement with AL Dept. of Corr. However, on 11-6-2020 I received a letter here at our home (that is dated 11-3-20) stating he has a mandated CRO appointment on 12-14-20. (It says this is mandated because of the drug possesion charge.) I'm simply confused because there was not any new charges acquired in 11-2020 simply a violation. So are they just super behind in mailing this letter or are they giving him a chance to apply for CRO diversion or does his sentence to ADOC trump all of this?

A: If your husband had an attorney when he pleaded guilty to the original UPOCS, you should contact that attorney. Defendants who are placed on Community Corrections supervision are in the custody of ADOC, so "revocation" and violations work differently than probation if he has been on probation before.

If you are unable to speak with his previous lawyer, you should contact another lawyer in the county where he's being held.
