Denver, CO asked in Child Custody and Child Support for Colorado

Q: I havent seen my daughter in 3yrs. I pay child support and the mother makes excuses to not let me see her. Help.

The mother has more financial help from her husband and to top it off gets a substantial amount of money from tax returns (has 3 kids) she took off with my daughter(4yrs old) to Ohio for 3yrs and just recently married and moved to Iowa. My daughter was born in south dakota and when the mom left I went back home to colorado. She makes a decent amount of money from her job as well. Me, I struggle to make child support payments. Whenever I do get to talk to my daughter, once every 2 weeks, she'll ask to come see me and her mom usually responds with "no we cant" or "we dont have money" yet they have money to take trips. Naturally my daughter cries and runs away. Not being able to save money to see her had depressed me more than I know. Doesmt help that this is my first child and it's my exs 3rd. I just want to know if there's anything I can do especially since fathers basically are not looked at as equal in a parental role (compared to mothers) to their kids. Any help would be awesome

A: IS THERE AN EXISTING ORDER RE PARETING TIME? IF SO, YOU SHOULD SEEK TO ENFORCE IT. IT MAY NEED TO BE MODIFIED IF THE DISTANCE MAKES IT IMPRACTIBLE TO FOLLOW. GIVEN YOUR DAUGHTER'S AGE, IT IS LIKELY ANY VISITATION WILL BE WHERE SHE LIVES-SO YOU MAY NEED TO GO THERE FOR THE VISITS.

IF THERE IS NO ORDER, YOU CAN FILE A CASE TO ESTABLISH PARENTING TIME.

YOU SHOULD GET A LAWYER TO HELP YOU WITH ALL THIS.

A: I am sorry to hear about your situation. If there is a parenting time order, then you can enforce it. If you do not have an order, then you could ask a court to issue one. You are entitled to time with your child. The state where the child has lived for the past six months is the state that has jurisdiction over the matter.
