Carmichael, CA asked in Civil Rights for California

Q: Is this housing discrimination? when my old roommates moved out, my landlord gave me the first choice for a candidate.

it was my black gay male friend. he made him pass a background check, credit report, income, and met him in person my friends info all checked out. plus he had deposit to put as a down payment. my landlord kept hesitating and making excuses as he pushing this white female through. she was unemployed, terrible credit and a iffy background. she is chosen over my friend. once she became roommate, my landlord would jump to her side with every disagreement we has. told me if im unhappy with her he i can leave. she started and argument, ran and told him.i pleaded for him to hear me out as well. he dismissed me. next morning, there is a surveillance camera in the common area and and locks on only her cabinets with her belongings in them.no explanation. told me i had to pay for mine. quiet hours only catered to her schedule. no complaint i made against her was reprimanded. im getting evicted, because she is unwilling to be cordial with me. ive lived here a year. shes been here 2 months.

A: It appears to me that this may have been a discriminatory rental decision, and that you have been victimized as well as your black friend who was denied housing. You need to file a claim with the California Department of Fair Employment and Housing immediately. Go to the DFEH website (https://www.dfeh.ca.gov/). Copy and paste the link into your browser, then click the link for Complaints and follow the procedure to set up your account and fill out the complaint form. Do this asap so you can put an immediate stop to any efforts by your landlord to get rid of you.

You should also advise your black friend to file his own complaint and reference each complaint to the other so the DFEH can get the full picture.

You should also look for an attorney who might help you. You can do that by contacting the Bar Association in your county and then go to their lawyer referral service (LRS). Every county has one.

DO NOT DELAY.

A: Racist and sexist. File with DFEH and sue LL in small claims for $10k. Your Black, gay friend has a better case, Racist, sexist and sexual orientation discrimination, he is entitles to a minimum penalty of $4000 under Civil Code 51, et seq. Unruh Civil Rights act. He should get an attorney and file a limited jurisdiction suit for $25k. Punitive damages are available. First thing you need to do is give LL a "repair and deduct" notice that you intend to put locks on all your cabinets and deduct cost from your rent, give him 1 week to install the locks. (if he can do overnight for her, he can do for you in a week.) If you can obtain any copies of her lease application or credit report, social security number, CDL, this would be good for investigation purposes. Give LL a notice that you are not responsible for any part of her rent.
