Walker, LA asked in Criminal Law for Louisiana

Q: Will a felony (possession of hydrocodone) from 2005 be automatically expunged by now?

BRPD served a search warrant on my house in 2005. They did not find anything near what their informants had said they'd find but they charged me with several exaggerated charges plus one charge that was outright unfounded. I took a plea deal to simple possession of hydrocodone. The judge gave me a suspended sentence of 3 years to be served on probation. After approximately 1.5 years, the judge terminated my sentence because of my compliance. I really think I remember the judge telling me that I'd be able to expunge my record but I have also read that in Louisiana, first offense felony's that aren't violent, sexual, etc are automatically expunged after 10 years if there are no additional felonies in that time.

I would like to purchase a firearm legally and I'm pretty sure Louisiana allows people like me who end up having their felony expunged to have their gun rights back.

A: NOTHING is expunged automatically. Hire a criminal lawyer to get an expungement.
