Plant City, FL asked in Civil Litigation for Florida

Q: My counsel filed a motion to withdraw. A hearing is being held via Zoom in one week. Can a this hearing be continued?

I need more time to familiarize myself with Zoom and consider retaining new counsel. Thanks

A: Rather than waste time trying to "familiarize yourself with Zoom" why not just seek new counsel? Why? Because most judges will NOT require a lawyer to stay in a case because there is an obvious conflict already.

A: Until the Court grants the motion to withdraw, your attorney is ethically obligated to represent you, and that includes advising you how to appear at the hearing, so I would start by asking him/her how to get on Zoom. Even without his/her help, the option of CALLING into the Zoom hearing does not take any familiarization, other than calling any of the listed numbers and entering the ID no. and password when prompted. Regarding the issue of time to retain new counsel, the Court, upon entering the order granting withdrawal, must give you time AFTER THAT to retain counsel, and the norm is 20 to 30 days (but could be less or more). Of course, it would be wise to start consulting other attorneys immediately.
