Q: Hi ,I'm looking for a police brutality cases in california that won . how do i find them ?

My son was severely beaten by sheriffs ,one cop broke his leg and the others broke,fractured their fist and wrist beating my sons head in causing 5 large lacerations to his scalp and face . Now he's being charged with 148's and 69's pc (about 10 each) and I'm looking for similar cases that won so I can refer them . How do I look for cases that won ?

A: You are not going to find any. Reported cases by Appellate Courts mainly deal with procedural or evidentiary issues supporting a conviction at trial which are rarely reversed and even when they were 9reversed), the case was remanded back to the trial court for re-trial.

PC 69 is a "wobbler" meaning it can be charged as a felony or a misdemeanor while PVC 148.5 is a straight misdemeanor. Misdemeanors carry penalties of 1 year in jail and/or a $1,000 fine per count.

If PC 69 is charged as a felony, your son is facing 16 months (low term), 2 years (mid term) or 3 years (high term) jail time per count.

You can do the math. Your son is potentially faced with having to serve a decade (or more) in county jail or state prison even with a plea bargain deal dismissing most of the counts.

You can't handle this yourself (you are not an attorney and cannot represent him) and an overworked public defender will plead him out as best he or she can do.

You should consult with and hire a skilled and experienced criminal defense attorney who handles resisting arrest cases. Also, your son may have a viable Police Misconduct civil claim against the officers involved and Sheriff's Department but a Government Tort Claim must be submitted on your son's behalf within 6 months of the date of his injuries.

Ideally, you would want to hire an attorney who "wears two hats" in being able to handle both the criminal and civil side. You got lucky by my having responded to your question as I am one of the few who does with a proven track record of success. The Cochran Law Firm (founded by Johnny Cochran of OJ Simpson fame is deceased) is another but they are very selective in the types of cases they agree to take on and require a substantial retainer paid up front (50k or more) because these type of cases (both on the criminal and civil side) are difficult to win, time consuming and cost intensive.

you either hire a lawyer or have one appointed by the court at the arraignment.

Because he was beaten does not mean there was police brutality........all the info is necessary. What was he doing to cause the police to contact him?

A: This would be a VERY hard path for you without an attorney. You should talk to some local attorneys right away. Don't wait because actions against government actors have very short and strict Statutes of Limitations. Meaning if you wait you cannot thereafter pursue them.
