Q: My ada federal fall attorney lost his license. I have full body crps. He wants me to sign with his friend for 50/55 fee.

It’s complicated because I fell six days after workmen’s comp surgery and so now it’s difficult trying to figure out what amount crps is from. Workmen’s comp asked for 1.8 mill in medical. Since I haven’t signed fee agreement, I think it’s too much, two settlement meetings have now been postponed!! Lawyer has not had any extra fees because all exams, depos, etc has been taken from workmen’s comp case. We were starting settlement talks and now I’m afraid everything is stalled due to lawyer being suspended. I need to get someone to take over at a reasonable fee. The lawyer he wants usually charges 33/40 but is asking me for more! I’m disabled and in 4th stage. This is causing huge issues and I’ve been evicted and living in an auto. I’m not getting any money besides ssi. I need help. My workmen’s comp has no experience in federal so I need to find outside help.

A: You have the right to negotiate the fees to be paid to your own lawyer. Just because your suspended lawyer recommends his friend, I suggest you look for other lawyers experienced in handling your case. You also should have a good worker's compensation lawyer representing you, because it appears you have a very good worker's comp case going as well. From the limited amount of information you have provided, I think it is critical that you have very good legal counsel. I recommend you contact Gary Gwilliam in Oakland. Or Brooks Cutter in Sacramento. You should be able to find either of them very easily. I know them both, and they are each highly qualified.
