Marco Island, FL asked in Real Estate Law for Florida

Q: I want the Ins Company who paid our HOA on a claim to tell me the amount. Don't I have a right to this information?

I own a condo and therefore and part of an association I'm trying to find out the amount of money the insurance company paid out on the last hurricane claim from the insurance company. I did get the amount from the bookkeeper of the association but I want to verify it with the insurance company. They won't tell me can they do this? Don't I have a right to that information?

A: Not from the insurance company. You can verify the amount by sending a certified letter, return receipt to the association to inspect the official records. At the records inspection you can ask to see a copy of the check and the bank statement for the deposit. At the inspection you can make copies for free with a smart phone or other smart device. The association has ten (10) business days from the day the sign for your letter to comply with your request. Do not ask for copies to be sent to you because the state agency regulating condominium associations has determined that is an improper request. The association can respond by sending you copies rather than giving you the inspection, so if you tell them in the letter what you want to see, they will accommodate your request if they are dedicated to transparency and not hiding something.
