Q: How can i file for an emancipation petition as a minor

A: If you are a member of a recognized tribe, you will need to determine if the Indian Child Welfare Act affects the ability to petition in the courts of the State of Arizona. I do not believe the ICWA applies unless the court is removing a child from their home for placement in another home. Emancipation is a different proceeding and you may be able to be emancipated per state law even if it is not recognized on tribal lands. I would suggest consulting with an attorney versed in tribal law and the ICWA to be on the safe side.
