A: While mishandling a case and missing deadlines might possibly give rise to a legal malpractice claim, that attorney's entire file would have to be reviewed in order to determine if malpractice occurred, and if so, to determine if the facts and circumstances may give rise to a worthwhile claim. Also, in the situation you describe, a client is possibly the victim of malpractice only if and when the client has actually been damaged by the final outcome of the case, including after any appeals. If you happen to be in a case that is not yet closed, and you think your lawyer is not properly handling the case, it's best to look for another attorney to take over the case.
