Q: My car was parked. Trailer hit it. Company denied thr claim. I got video footage of the accident. What amount can I sue?

My car was parked on the street. And a trailer hit my car. When I went to ask the company to view the cameras the told me it didn't work. So I had to open a claim with my ins and have been worried sick on how I was gonna come up with the deductible. Fast forward 3 days and I was finally able to get my hands on video footage of said company trailer hitting my car. Can I press charges for a hit and run? What can I sue for? I want justice. This is not ok!!

you can make a claim for the amount of the property damage to your parked vehicle.

if you were in it, you can also make a claim for injuries/damages to you

A: You can contact the police and make a report. The police and the DA decide whether to pursue charges.

You insurer might waive the deductible, or you will probably get it back after your insurer collects from the responsible party.

Once your insurer pays, you can no longer sue the other party for that damage. You might still be able to pursue a claim for loss of use (rental car expense), but you would have to do so in conjunction with your insurer. If you don't coordinate, you could damage your insurer's ability to recover for the sums it paid to you, and you would be in breach of your obligations to your insurer.
